Thailand legalizes distribution and possession of some narcotic drugs, including cocaine, for limited medical use and research

Thailand’s Royal Gazette yesterday, November 16, has announced new Ministerial Regulations on permission to sell or possess narcotics in category 2 B.E. 2563 which will take effect in 240 days.

A total of 102 types of narcotics, such as coca leaves, cocaine, codeine, a concentrated extract of dried opium, methadone, morphine, opiates (opium processed for medicinal use) opium (raw opium, cooked opium, opium waste) and others are legally allowed to be used and sold only with a legalized license and under some limited conditions.

A Thai government licensor may consider issuing a license to distribute narcotics of category 2 when it appears that the applicant wishes to sell narcotics of category 2, only in the following cases:

  1. For medical treatment or prevention of disease for authorized patients or sick animals.
  2. For analysis of medical and scientific research
  3. For the benefit of the government

Additionally, a licensor may consider issuing a license to possess narcotics of category 2, when it appears that the applicant wishes to possess narcotics of category 2, only in the following cases:

  1. For the production of narcotics of category 3 (narcotics which are in the form of medicinal formula and contain narcotics of category 2 as ingredients such as cough syrup and diarrhea medicine)
  2. For educational purposes
  3. For analysis of medical or scientific research.
  4. For the benefit of the government
  5. For regular first aid use or in case of emergency on ships or aircraft used in international public transportation registered in the Kingdom.

This Ministerial Regulation shall come into force 240 days from the date of its publication in the Government Gazette. The Ministerial Regulation No.2 B.E. 2522 shall be repealed under the Narcotics Act, B.E. 2522.
