On September 24th, 2024, the Thai Royal Gazette published the Civil and Commercial Code Amendment Act 2024, also known as the Marriage Equality Law. This law allows marriage between individuals regardless of gender.
Key points of the law include:
- Individuals of any gender can now get engaged or married.
- Terms like “husband,” “wife,” and “spouse” are replaced with “person,” “fiancé,” and “partner” to include all genders.
- Legal grounds for compensation and divorce are extended to cover relationships with any person, regardless of gender.
- Specific marriage conditions under Section 1453 now only apply to women remarrying men.
- Section 1504 regarding pregnancy before legal marriage applies solely to male-female marriages.
- Adjustments are made to court procedures for declaring a person incapacitated.
The law will take effect 120 days after its publication, meaning that registrations under the new law will begin on January 22nd, 2025.
